Terms of Sale and Website Use

The short version. An order is final only after Acme confirms it. Prices and fit are checked by a person before anything ships. With pay later checkout, no payment is taken until we confirm your order and send an invoice or payment link. Returns need our approval first. Warranties come from the part's manufacturer. These terms are governed by New York law.

About these terms

These terms apply when you use this website or buy parts or services from Acme Radiator Inc., 49 Carleton Avenue, Islip Terrace, NY 11752 ("Acme", "we", "us"). Our Classic Radiator department is part of the same business. By placing an order or using the site, you agree to these terms. Our Privacy Policy explains how we handle your information.

Orders and confirmation

  • Placing an order is an offer to buy. It becomes a sale only when Acme confirms it.
  • We check every order. Before an online order ships, we confirm that the part fits your vehicle, that it is in stock, and what shipping will cost.
  • We may decline or cancel an order, for example if a part is unavailable, does not fit, or was listed with a wrong price or description. If you already paid for an order we cancel, we refund you in full.
  • Quote requests are not orders. A quote is our price for the parts and details you gave us. It is not a sale until you accept it and we confirm the order.

Fit and part information

We work hard to show accurate part numbers, specifications and vehicle fitment. Fit can vary by trim, options and earlier repairs, so please call 631.581.9199 if you are unsure. Photos may show a similar part, not the exact one you receive.

Prices and account pricing

  • Prices are in US dollars and can change at any time before we confirm your order.
  • Sales tax is added where the law requires it. Shipping is extra unless we say otherwise.
  • Account pricing: Acme may assign approved trade accounts to a pricing tier. Account pricing is shown only to that account when it is signed in. Please keep your account pricing and sign in details private.
  • If a price is listed in error, we will contact you before we fill the order at the correct price, or cancel it.

Payment and pay later invoices

  • Pay later checkout: you can place an order online without a card. Acme confirms fit and shipping, then sends you an invoice or a secure payment link. No payment is taken until then.
  • Please pay according to the terms shown on your invoice. Unless your account has approved credit terms with us, payment is due on receipt and we ship or release orders for pickup after payment.
  • Online card payments are processed by Stripe. Acme never stores your full card number.
  • We accept Visa, MasterCard, Discover and American Express. We do not accept personal checks.

Shipping and pickup

You can pick up at our shop or have your order shipped. Shipping cost, timing and delivery problems are covered on our Shipping and Pickup page. Ship dates are estimates, not guarantees.

Returns

Returns need Acme's approval first. Request a return from your account, then wait for our instructions before sending anything back. Submitting a request does not authorize a shipment and does not issue a refund. Full details are on our Returns and Warranty page.

Warranty

Parts we sell carry the warranty of the company that made them, and coverage varies by manufacturer and part. Repair and recore work done in our shop is covered as described on your repair invoice. Except for those warranties, parts and services are sold as is, and Acme makes no other warranties, including implied warranties of merchantability or fitness for a particular purpose, to the extent the law allows.

Limitation of liability

To the extent the law allows:

  • Acme's total responsibility for any claim about a part or service is limited to the amount you paid Acme for that part or service.
  • Acme is not responsible for indirect or consequential costs, such as installation or removal labor, towing, rental vehicles, downtime, lost income, or damage to other parts of your vehicle or equipment.

Some states do not allow these limits, so they may not fully apply to you. Nothing in these terms limits rights you have under the law that cannot be waived.

Using this website

  • Keep your account sign in details private. You are responsible for orders placed through your account.
  • Please do not misuse the site, for example by trying to break into accounts, overload our systems, copy our catalog in bulk, or submit false orders.
  • Text, photos, logos and other content on this site belong to Acme or the companies that own them. Do not copy them for commercial use without our permission.
  • We may update, suspend or change the site at any time. Links to other websites are provided for convenience; we are not responsible for their content.

Governing law

These terms are governed by the laws of the State of New York. Any dispute about these terms, an order or the website will be handled in the state or federal courts located in New York, unless the law requires otherwise.

Changes to these terms

We may update these terms. The date at the top of this page shows when they last changed. The terms in effect when you place an order apply to that order.
